TERMS AND CONDITIONS
Interpretation
‘Services' means all services provided by ‘Built Energy’. ‘User’ means any person who accesses www.builtenergy.com or uses any service provided by ‘Built Energy’. ‘Data’ means information in any format, communicated from or transmitted to the User in accordance with a Service. ‘Personal Information’ means Personal Data as defined in the Data Protection Act 1998.
User Responsibility
By using services offered by ‘Built Energy’ or www.builtenergy.com, the User acknowledges and agrees to be bound by these ‘Terms and Conditions’, including the acceptance of liability as detailed.
Website
Users are permitted access to www.builtenergy.com in order to view our products and services. No portion of www.builtenergy.com or associated logos / images may altered, reproduced, copied or sold. Links to our website can only be made after written authorization from Built Energy has been received – conditions will apply. Users who wish to advertise on our website should contact info@builtenergy.com. Built Energy reserves the right to prohibit access by person(s) to our services at its sole discretion.
Surveyors
The appointed Energy Surveyor / Assessor will be fully accredited, have received a Criminal Records Bureau check and carry full indemnity insurance. The Domestic Energy Assessment (DEA) provided is as extensive as access and circumstances permit.
Inspection
The report does not intend to express an opinion or to advise upon the condition or energy ratings / values of parts not inspected. The Surveyor does not lift fitted carpets, move heavy furniture or remove fixtures or fittings to facilitate inspection. Roof areas / exteriors are inspected from ground level and roof voids are inspected assuming a suitable access point is available, but stored items will not be moved. A structural survey or test of service installations will not be carried out.
Liability
Unless otherwise expressly agreed, the assessment advice and certification assumes that:-
The property is unaffected by any statutory notice and that neither the property nor its use or proposed use gives rise to a contravention of any statutory requirements. The Surveyor is under no duty to verify these assumptions.
The Surveyor gives his professional opinion, and neither he or ‘Built Energy’ accept any liability of matters arising in connection with these Conditions of Engagement or any matters resulting in economic loss or loss of profits suffered by the Client or any third party. Where energy saving costs are provided, they are for guidance purposes only and should not be construed to be a neither quotation nor estimate and should be substantiated prior to exchange of contracts by proper competitive quotations or estimates.
Complaints
Any dispute or difference which may arise between the Surveyor and the Client in connection with these Conditions of Engagement or in connection with any matters arising there from, shall be put in writing to ‘Customer Services’, Built Energy, Rokeby House, Rokeby Green, The Mall, Armagh, BT61 9AT.
Applicable Law
The law and practice to be followed by determining a dispute or difference shall be the law governed by UK, European and International Laws and shall be subject to the jurisdiction of the UK courts.
Privacy
The report is confidential to the Client for the specific purpose to which it refers. However, the data collected may be disclosed to other professional advisors assisting the Client in respect of that purpose and for future Client information updates.
Payment
Payment must be made before the property survey takes place, directly to Built Energy or nominated representative. If your order is registered under an incorrect price, your survey maybe cancelled or an additional fee maybe due. If payment is not made or does not clear, the EPC cannot be released until full payment is received. The energy performance certificate will not be delivered until the additional payment is made.The Client agrees to pay the professional fee as agreed including any Value Added Tax applicable.
Delivery
We will provide you or a designated agent with an electronic version of the EPC, normally within seven working days of the appointment (assuming there are no outstanding items). Those Clients who order a hard copy of the report will receive an EPC by post, sent via surface mail within seven working days (subject to mail service availability)
Cancellation by you
We aim to be flexible with our Clients and accept cancellations up to 48 hours before the appointment. Unfortunately cancellations after this time or failure to meet appointments / conditions will result in a ‘No Show' charge of £30.00 payable to ‘Built Energy’.
Cancellation by us
We reserve the right to cancel or postpone your order subject to surveyor availability, health and safety considerations or identification of a conflict of interest.
Variation
Built Energy reserves the right to vary or amend these Terms and Conditions at any time without notice. Users will be deemed to have accepted variations in continuing to use our services or website after these have been posted.
